With the confirmation of Chair John F. Ring in April 2018 and General Counsel Peter B. Robb in November 2017, the Trump Board was poised to review and overrule many of the Obama Board decisions and GC initiatives, using decision making, GC and Advice memos, and rulemaking to address controversial legal issues, including the status of graduate assistants, joint employer, and revised R case rules.
Both the Board and the GC have moved to change such areas as access to an employer’s email system (Purple Communication), handbook rules, access to union organizers (Kroger), independent contractor (Velox), and the right to protest using the rat, cat or other banners (GC memo).
GC memos also have impacted how the union does its job (DFR and GM/Beck notices), and Board decisions have granted employers the right to make unilateral changes without bargaining (Raytheon and MV Transportation).
