Forum on NLRB's Dana Ruling on Card Check

Please come to a special Labor and Employment Program Law Breakfast to discuss the NLRB’s long anticipated Dana Corporation/Metaldyne Corporation decision (3?2), which limits the recognition bar doctrine when card check recognition is used is lieu of elections. Specifically, the bar will attach only when “. . . (a) affected unit employees receive adequate notice of the recognition and of their opportunity to file a Board election petition within 45 days, and (b) 45 days pass from the date of notice without the filing of a validly?supported petition.” If a valid petition is filed, the NLRB will hold an election.
