The NLRB under Mark G. Pearce has issued several decisions and regulations that continue to spark controversy. Headlines have included cases and rules involving the micro-bargaining unit decision in Specialty Healthcare; the "speed-up" election regulations, now on hold; the Dana decision, upholding pre-election agreements; the Notice Posting Rule, which may be headed to the Supreme Court; and a stream of 8(a)(1) violation cases, including class action waivers in Horton, employers prohibiting discussions involving ongoing investigations in Banner, and, of course, the use of social media by employees.
