Guardianship and Post Secondary Education
What does "guardianship" permit the parent to participate on the college level?

This scenerio originates with a student with autism, does not drive, parent will drive the student to the college, parent would like the student to take one class, parent would like to assist the student with note taking if the note taker is an available service, parent is obtaining guardianship at the cost of $4,000., job development in the community has been unable to identify an employer who will accomodate the limited physical capabilities, etc.

Summary, Is the college required to address the planning of student services with a parent who has guardianship?

Guardianship and even parent rights are not so much a 54/ADA issue as they are FERPA issues. FERPA: Family Educational Right Privacy Act. This is the basis for all the college confidentiality policy issues. The historical perspective for disability folks has been that we CAN'T talk to parents. We can't give them grades etc. Virginia Tech has caused much of the interpretation and application of FERPA to be revisited. What has really not changed is that the parent can talk to DSS if the student gives the office written permission for DSS to talk to the parent- some issues are still going to be off limits-grades, attendance etc.

Regarding the parent as the notetaker. In my opinion this is a really bad practice. The parents are highly vested in the success of the student are are likely to over accommodate the student. Colleges all have ways of providing notetaking services from carbon copies of notes to paid notetakers to everything online at a website depending on the campus. College students regardless of disability need to acquire and demonstrate a level of independence and notes are a pretty safe way to do that. Students can concurrently tape record the class to capture anything that was missed by the class notes. Parents in class make it too much like high school. If you regard college as a conduit to independence and employment, then the parent weaning him/her self from service provision is essential.

It is my understanding that with written permission, the schools can give the information to whomever the student wants. According to ed.gov and the FERPA explanation "Generally, schools must have written permission from the parent or eligible student in order to release any information from a student's education record". I've seen schools release information with signed consent.

Guardianship question
My belief is Legal Guardianship of the MR/DD Article 17a of the Surrogate Court act (and wow 4,000 is alot of money to pay for it) gives the appointed guardian the same rights as a parent of a minor. Having said that there are standards that a good guardian should follow that require that "best interests" are the basis of decision making.

There is another type of Guardianship (article 81) out of Supreme Court which allows for a more taylor made guardianship and doesn't wholesale remove the person's rights.. it is pretty pricy..

http://www.ddpc.state.ny.us/ ususally has a book that is downloadable called Planning your Future that covers all of this but they are reorganizing their web site and they only have a link for the spanish version. I think they will repost it soon. If not we have copies at PN I can send out...
